1. Acceptance of these terms

These Terms of Use govern your access to and use of Portfolio Watch at portfolio-watch.com, including all pages, data displays, and the email digest (together, the “Service”). By accessing or using the Service you agree to be bound by these terms. If you do not agree with them, please do not use the Service.

We may revise these terms from time to time. The revision date at the top of this page indicates when they were last changed, and continued use of the Service after a change constitutes acceptance of the revised terms.

2. No investment advice

This is the most important term on this page, and it is not a formality.

Portfolio Watch does not provide investment advice. All content, ratings, charts, simulations, screens, calendars, and data are provided strictly for informational and educational purposes. Nothing on the Service constitutes investment advice, financial advice, trading advice, tax advice, legal advice, or a recommendation, offer, or solicitation to buy or sell any security or financial instrument.

We are not registered as an investment adviser, broker, dealer, or financial planner in any jurisdiction. We have no knowledge of your financial circumstances, investment objectives, tax position, time horizon, or risk tolerance, and nothing presented on the Service is tailored to them or suitable for any particular person.

You are solely responsible for your own investment decisions and for any consequences arising from them. You should perform your own research and consult a licensed financial professional before acting on any information obtained from the Service.

3. Investment risk

Investing in securities involves substantial risk, including the possible loss of the entire amount invested. Options carry additional risks, including the total loss of premium paid, obligations arising on assignment, and losses that may exceed the initial outlay in certain strategies.

Any backtested, simulated, or hypothetical performance shown on the Service is exactly that: hypothetical. It does not represent actual trading, no money was managed under the rules described, and it carries documented biases that are set out on our methodology page and in the relevant guide. Past performance, whether actual or simulated, is not a reliable indicator of future results.

4. Data accuracy and availability

The Service aggregates data from third-party public sources. We do not originate market data and we do not warrant its accuracy, completeness, timeliness, or fitness for any purpose.

  • No data on the Service is a real-time quote. Figures are cached or produced by scheduled jobs and may lag the market by minutes or hours. Refresh intervals are published on the methodology page.
  • Third-party sources may supply values that are delayed, incomplete, or subsequently revised, and may become unavailable without notice.
  • Some text on the Service, specifically company profiles and digest summaries, is generated by automated language models and may contain errors. This is disclosed where it occurs.
  • We may modify, suspend, or discontinue any part of the Service at any time without notice, and we do not guarantee uninterrupted availability.

Do not rely on the Service for trade execution decisions or for any purpose requiring current or verified market prices. Verify all figures against your broker or another authoritative source before acting.

5. Email digest

If you provide an email address to receive the daily digest, you consent to receiving those messages at the address supplied. Every digest contains a link that pauses delivery immediately. You may also request deletion of your stored data by contacting us at the address in section 11.

The Service identifies your saved preferences by email address rather than by password. You are responsible for supplying an address you control, and you should not enter another person's address.

6. Acceptable use

You agree not to:

  • Use automated means to scrape, harvest, or systematically extract data from the Service, or place unreasonable load on our infrastructure.
  • Attempt to gain unauthorized access to any part of the Service, its servers, or any connected system, or interfere with its normal operation.
  • Access another person's saved preferences or submit an email address you do not control.
  • Redistribute, resell, or republish data obtained from the Service as a commercial data product.
  • Use the Service for any unlawful purpose or in breach of any applicable law or regulation in your jurisdiction.

We may restrict or terminate access for any user who breaches these terms.

7. Intellectual property

The original written content of the Service, including the guides in the Learn section, the methodology documentation, the glossary, the site design, and our compilations and calculations, is owned by Portfolio Watch and protected by copyright.

You may quote short extracts for personal, editorial, or educational purposes provided you attribute them to Portfolio Watch and link to the source page. You may not reproduce substantial portions of the Service without prior written permission.

Third-party names, marks, ratings, and data referenced on the Service remain the property of their respective owners. Reference to them does not imply any affiliation with, sponsorship by, or endorsement from those owners. Portfolio Watch is an independent project and is not affiliated with Zacks Investment Research, any exchange, index provider, or data vendor mentioned.

8. Advertising and third-party links

The Service is funded partly by third-party display advertising and by voluntary reader contributions. Advertisements are selected and served by third-party networks. We do not choose, review, or endorse individual advertisements, and the appearance of an advertisement is not a recommendation of the advertiser or its products.

The Service may contain links to external websites. We do not control those sites and are not responsible for their content, products, or practices. Where a link may earn us a commission, we disclose it. Advertisers and affiliates have no influence over our editorial content, our calculations, or which securities appear on the Service.

9. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Nothing in these terms excludes or limits any right or remedy you may have under consumer protection law that cannot lawfully be excluded or limited.

10. Limitation of liability

To the fullest extent permitted by law, Portfolio Watch and its operator shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any trading losses, lost profits, lost opportunities, or loss of data, arising out of or in connection with your use of or inability to use the Service, whether based in contract, tort, negligence, or any other legal theory, and whether or not we were advised of the possibility of such damages.

You acknowledge that you use the Service entirely at your own risk and that any investment decision you make remains your sole responsibility.

11. General

If any provision of these terms is found unenforceable, the remaining provisions continue in full effect. Our failure to enforce any provision is not a waiver of it. These terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

These terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict-of-law principles. You agree that the state and federal courts located in New Jersey shall have exclusive jurisdiction over any dispute arising out of or relating to these terms or your use of the Service, and you consent to the personal jurisdiction of those courts.

The Service is operated from the United States. If you access it from elsewhere, you do so on your own initiative and are responsible for compliance with your own local laws. Nothing in this section deprives you of the protection of any mandatory consumer law of your country of residence that cannot be excluded by agreement; where such law grants you greater protection or a right to bring proceedings in your local courts, that law continues to apply to you.
